Terms and Conditions for Riders

Please read these Terms carefully before creating an Account or requesting a Ride. They explain the respective roles of GB TAXI POLSKA, the Transport Provider and the Rider.

1. Operator and scope

1.1. These Terms and Conditions govern the registration, access to and use of the GB TAXI POLSKA mobile application, website and related Rider services in Poland.

1.2. The GB TAXI POLSKA service is operated by GBLAST MOBILITY spółka z ograniczoną odpowiedzialnością, Aleja Wojska Polskiego 14, 05-820 Piastów, Poland, entered in the Register of Entrepreneurs of the National Court Register under KRS 0001172063, NIP 5342694563, REGON 541684040, telephone: +48 452 153 303, website/contact: https://GblastMobility.pl (“GB TAXI POLSKA”, “we”, “us” or “our” in these Terms, unless a provision specifically refers to the legal company name).

1.3. Rides are performed by independent Transport Providers and Fleet Partners that are responsible for holding and maintaining the taxi, transport, vehicle and local operating licences, permits and registrations required for the cities and areas in which they operate. GB TAXI POLSKA may request evidence of such licences from Transport Providers and may restrict access to the Application where the required evidence is missing, expired or invalid.

1.4. These Terms constitute the regulations for electronic services provided through the Application. They are available free of charge before registration and may be saved, downloaded and reproduced.

1.5. By creating an Account or confirming a Ride Request, the Rider agrees to these Terms and to the documents expressly incorporated into them, including the current Pricing, Cancellation and Refund Policy and Community and Safety Rules.

1.6. The Privacy Notice and Cookie and App-Tracking Policy describe the processing of personal data and are not treated as consent to processing where another lawful basis applies.

1.7. Where acceptance of these Terms is required before registration or a paid Ride Request, the Application must provide the Rider with the possibility to review and accept these Terms before submitting the request.

2. Definitions

2.1. Account means the individual Rider account created in the Application.

2.2. Application means the GB TAXI POLSKA mobile application, website and related digital services operated under the GB TAXI POLSKA brand by GBLAST MOBILITY sp. z o.o.

2.3. Driver means the individual authorised by a Transport Provider to perform a Ride.

2.4. Electronic Payment means payment by credit or debit card, BLIK or another cashless method available in the Application.

2.5. Fee Policy means the current Pricing, Cancellation and Refund Policy made available in the Application or on the website.

2.6. Fixed Fare means the price displayed before confirmation of a Ride Request, subject only to the permitted adjustments described in these Terms and the Fee Policy.

2.7. Rider means the person who creates an Account, submits a Ride Request or travels on a Ride ordered through the Application.

2.8. Payment Service Provider means an authorised external provider processing Electronic Payments.

2.9. Ride means the Rider transport service requested through the Application and performed by a Transport Provider.

2.10. Ride Request means a request submitted through the Application for a Ride.

2.11. Transport Contract means the Rider transport contract concluded directly between the Rider and the relevant Transport Provider.

2.12. Transport Provider means the licensed fleet, carrier, sole trader or other entity that accepts responsibility for and performs the Ride through its Driver.

2.13. Vehicle means the vehicle used to perform the Ride.

3. Electronic services and technical requirements

3.1. GB TAXI POLSKA provides electronic services consisting mainly of Account creation and management, displaying transport offers, matching Ride Requests with Drivers, presenting prices, facilitating communication, facilitating payments, displaying ride history and providing customer-support functions.

3.2. Use of the Application requires a compatible internet-connected device, a supported operating system or web browser, an active telephone number and, where relevant, permission to use location services.

3.3. The Rider bears the costs charged by their internet or telecommunications provider.

3.4. The Rider must not submit unlawful content, introduce malicious software, interfere with security, scrape or reverse engineer the Application except where mandatory law permits it, create false Accounts, manipulate fares or promotions, or use automated systems without written permission.

3.5. GB TAXI POLSKA may update the Application, technical requirements and available functions. Some functions may not be available in every location, device or Account.

4. Registration and eligibility

4.1. A person creating an Account must be at least 18 years old and have legal capacity to enter into contracts.

4.2. Registration may require a name, telephone number, email address, payment method and verification information.

4.3. The Rider must provide accurate, complete and current information and update it when it changes.

4.4. Unless GB TAXI POLSKA permits otherwise, one person may maintain only one personal Account. Accounts may not be sold, rented, transferred or shared.

4.5. GB TAXI POLSKA may request additional verification for account security, payment verification, fraud prevention, complaint investigation or legal compliance.

4.6. Registration may be refused where information is false or incomplete, legal requirements are not met, serious previous misuse has occurred, or there is a reasonable risk of fraud, safety harm or unlawful activity.

5. Account security

5.1. The Rider is responsible for protecting login credentials and verification codes and for preventing unauthorised access to the Account.

5.2. Suspected unauthorised access must be reported to GB TAXI POLSKA without undue delay.

5.3. The Rider is responsible for activity performed through the Account unless the Rider demonstrates that the activity occurred without authorisation and was reported without undue delay.

5.4. GB TAXI POLSKA may temporarily secure or restrict an Account where unauthorised access or payment misuse is reasonably suspected.

6. Role of GB TAXI POLSKA and the Transport Provider

6.1. GB TAXI POLSKA operates the Application and acts as a Rider-transport intermediary. It connects Riders with independent licensed Transport Providers.

6.2. The Transport Contract is concluded directly between the Rider and the Transport Provider whose Driver accepts the Ride Request.

6.3. GB TAXI POLSKA does not itself perform the Ride unless the Application expressly identifies GB TAXI POLSKA as the Transport Provider for a particular service.

6.4. The Transport Provider is responsible for the lawful and proper performance of the Ride, including Driver eligibility and conduct, Vehicle condition, licences, insurance, road safety and issuance of the applicable fiscal document.

6.5. GB TAXI POLSKA is responsible for its own obligations, including operation of the Application, intermediation, price presentation, payment facilitation, platform-level support and duties imposed on a Rider-transport intermediary.

6.6. The identity of the Transport Provider will be made available in the Application, ride details or fiscal document.

7. Requesting a Ride and formation of the Transport Contract

7.1. The Rider normally enters or confirms the pickup location and destination, selects the service category and payment method, reviews the displayed Fixed Fare and confirms the Ride Request.

7.2. The Rider must verify the pickup location, destination, service category, payment method and price before confirmation.

7.3. Submitting a Ride Request does not guarantee that a Driver will be available.

7.4. The Transport Contract is formed when a Driver accepts the Ride Request and acceptance is confirmed in the Application.

7.5. The Application may display the Driver's name, photograph, rating, Vehicle make, model and registration number and estimated arrival time.

7.6. Before entering the Vehicle, the Rider should verify that the Driver, Vehicle and registration number match the information shown in the Application.

7.7. Estimated arrival and journey times are indicative and may change because of traffic, weather, road restrictions, demand, map errors or other circumstances.

8. Fixed Fare and pricing

8.1. The Rider receives a guaranteed Fixed Fare before confirming the Ride Request.

8.2. The Fixed Fare may be calculated using estimated distance and duration, pickup and destination, service category, date and time, demand, Driver availability, operating area, known tolls or access charges and applicable promotions.

8.3. Ordinary traffic delays and reasonable route variations do not by themselves increase the Fixed Fare.

8.4. The Fixed Fare may be adjusted only where the Rider changes the destination, adds a stop, requests a materially different route, extends the Ride, requests waiting beyond the included period, incurs a disclosed additional charge, causes damage or excessive soiling, or the displayed price resulted from an obvious technical error.

8.5. Where technically possible, a material price change requested during the Ride will be displayed before confirmation.

8.6. Prices may differ by city, operating area, service category, time, demand or Transport Provider. The price presented before confirmation is binding for the requested Ride subject to these Terms.

8.7. Prices are displayed in Polish zloty (PLN) and include all mandatory charges known at the time of confirmation, including applicable taxes, unless a particular charge is clearly shown as additional before the Rider confirms the Ride Request.

9. Dynamic pricing and additional charges

9.1. During high demand or limited Driver availability, the Fixed Fare may include dynamic pricing. The adjusted price will be shown before the Rider confirms the Ride Request.

9.2. The Rider may choose not to submit the Ride Request if the displayed price is not acceptable.

9.3. Additional charges may include cancellation, no-show, waiting, toll, parking, airport, cleaning or damage charges where permitted by these Terms and clearly disclosed in the Application or Fee Policy.

9.4. The Rider will not be charged twice for the same cost.

10. Payment methods

10.1. Available methods may include cash, credit and debit card, BLIK, in-vehicle card-reader payments where available, and other methods introduced in the Application.

10.2. Availability may depend on location, service category, Account status and technical or payment-provider conditions.

10.3. The Rider must ensure that the selected payment method is valid and has sufficient funds.

10.4. A payment method may be refused or restricted where a transaction fails, verification is not completed, fraud is reasonably suspected or the Payment Service Provider rejects the transaction.

10.5. Tips are voluntary and are not included in the Fixed Fare unless expressly shown.

10.6. The current payment methods, payment-method descriptions and required payment or card-organisation logos may be displayed in the Application, on the website or on a dedicated payment-information page.

11. Cash payments

11.1. Where cash is selected, the Rider pays the amount shown in the Application directly to the Driver at the end of the Ride.

11.2. The Driver collects cash on behalf of the Transport Provider. The Transport Provider records the sale and issues the legally required receipt or invoice.

11.3. The Rider must not pay cash where the Ride has already been paid electronically.

11.4. Failure to pay a valid cash fare may result in collection of the debt, restriction of cash payments or suspension of the Account.

12. Electronic payments

12.1. Electronic Payments are processed by an authorised Payment Service Provider and are collected by or through GB TAXI POLSKA on behalf of the relevant Transport Provider.

12.2. Online payment processing may be provided by authorised payment service providers, banks, card acquirers, BLIK operators or other payment partners selected by GB TAXI POLSKA or the relevant Transport Provider. GB TAXI POLSKA does not guarantee that the same payment provider will be used for every transaction or in every city. Where an in-vehicle card reader is used, the transaction may be processed directly by the Transport Provider or its payment provider.

12.3. By selecting Electronic Payment, the Rider authorises verification of the payment method and charging of the fare and applicable disclosed charges.

12.4. For credit and debit card payments, processing of the Ride Request begins after positive payment authorisation or pre-authorisation, unless the Application expressly permits a post-payment flow. Where post-payment is used, the final charge is made after completion of the Ride in accordance with the fare and charges authorised under these Terms.

12.5. A temporary authorisation or reservation may appear before or during the Ride and may differ from the final charge.

12.6. If payment fails, GB TAXI POLSKA may retry the payment, request another method, restrict new Ride Requests or collect the outstanding amount through a later authorised transaction where legally permitted.

12.7. Complete credit and debit card details may be stored directly by the Payment Service Provider rather than by GB TAXI POLSKA.

12.8. A Rider may dispute an unauthorised or incorrect transaction. Knowingly making a false payment dispute or fraudulent chargeback may lead to Account restrictions and recovery of valid amounts.

13. Booking confirmations, receipts and invoices

13.1. Before confirmation, the Application displays a price summary or booking confirmation. This is not necessarily a fiscal receipt or VAT invoice.

13.2. After the Ride, the Transport Provider issues the legally required fiscal receipt or invoice.

13.3. The document may be issued directly by the Transport Provider or generated and delivered electronically through the Application on the Transport Provider's behalf.

13.4. A Rider requesting a VAT invoice must provide complete and correct invoicing information within any applicable legal or technical deadline.

14. Pickup and Rider obligations

14.1. The Rider must be ready at the confirmed pickup point when the Driver arrives.

14.2. Where the pickup point is unsafe, inaccessible or legally restricted, the Driver may stop at the nearest safe and lawful location.

14.3. The Driver may contact the Rider through the Application or the contact details connected with the Account.

14.4. The Rider must not intentionally provide a false pickup point or destination, submit fake Ride Requests or cause unnecessary Driver travel.

15. Cancellation, waiting and no-show

15.1. The Rider may cancel a Ride through the Application before the Ride begins.

15.2. A free cancellation period may apply after a Driver accepts the Ride Request. Its duration and any cancellation charge are stated in the Application or Fee Policy.

15.3. A cancellation charge may apply after the free period, after the Driver has travelled toward or arrived at the pickup point, or where the Rider does not appear after the applicable waiting period.

15.4. Waiting charges may apply after the free waiting period shown in the Application or Fee Policy.

15.5. Before marking a no-show, the Driver should be at or reasonably close to the correct pickup point and make a reasonable attempt to contact the Rider.

15.6. A cancellation or no-show charge will not normally apply where no Driver accepted the request, the Driver cancelled without Rider fault, the Driver or Vehicle did not match the Application, the Driver was at the wrong location, a serious safety concern existed, or an Application error caused the cancellation.

15.7. Scheduled Ride cancellation conditions may differ and will be shown before confirmation or in the Fee Policy.

15.8. A Rider may request review of an incorrectly charged cancellation, waiting or no-show fee.

16. Driver cancellation and service availability

16.1. A Driver may cancel or refuse a Ride for a lawful and reasonable reason, including an unsafe or inaccessible pickup, excessive Rider count, unavailable required equipment, unlawful request, serious misconduct, Vehicle failure or emergency.

16.2. The Rider will not be charged merely because the Driver cancels, unless the cancellation results from the Rider's no-show, prohibited conduct, incorrect pickup information or another circumstance for which these Terms permit a charge.

16.3. The Application may attempt to assign another Driver but GB TAXI POLSKA does not guarantee that a replacement or any Driver will be available.

16.4. If a Ride does not take place, any incorrect charge will be refunded and any temporary authorisation will be released, subject to bank processing times.

17. Changes during the Ride

17.1. The Rider may request a destination change, additional stop or early termination through the Application where available.

17.2. The Driver may refuse a requested change that is unlawful, unsafe, outside an authorised area, impossible to perform reasonably or incompatible with an already accepted booking.

17.3. A change may result in recalculation of the price. The Rider should confirm the revised price in the Application where available.

17.4. If the Ride ends early at the Rider's request, the original Fixed Fare may remain payable unless the Application displays a reduced amount.

17.5. If the Ride ends early because of Vehicle failure, Driver misconduct or another matter attributable to the Transport Provider, the Rider may request an appropriate refund.

18. Rider conduct and safety

18.1. The Rider and accompanying persons must behave lawfully, respectfully and safely and follow reasonable safety instructions from the Driver.

18.2. The Rider must not threaten, harass, discriminate against or assault another person; engage in unwanted sexual conduct; carry illegal or dangerous items; ask the Driver to break the law; interfere with driving; smoke or vape; damage or excessively soil the Vehicle; or use the Ride for unlawful activity.

18.3. All Riders must use seat belts where required and available, and the number of Riders must not exceed the lawful Vehicle capacity.

18.4. The Driver may refuse to begin or may end a Ride where conduct creates a reasonable safety, legal or property risk.

18.5. Serious incidents may be reported to the police or another competent authority.

19. Rides for other persons, minors and child restraints

19.1. The Account holder may order a Ride for another person where the Application permits it and remains responsible for payment and charges connected with that Ride.

19.2. A person under 18 may travel only with a responsible adult unless a dedicated service expressly permits unaccompanied minors.

19.3. The adult travelling with a child is responsible for complying with child-restraint requirements and for selecting an appropriate service where special equipment is required.

19.4. GB TAXI POLSKA does not guarantee that every Vehicle has a child seat unless a service including one was specifically selected.

19.5. A Driver may refuse transport where carrying a child would violate applicable safety rules.

20. Luggage, animals and assistance dogs

20.1. Ordinary luggage is included where it fits safely in the selected Vehicle. The Rider should select an appropriate category for oversized or numerous items.

20.2. The Driver may refuse an item that is illegal, dangerous, cannot be secured, exceeds capacity or is likely to damage the Vehicle.

20.3. A Rider travelling with an animal should select an appropriate option where available or inform the Driver promptly after acceptance.

20.4. Animals must be controlled and, where appropriate, transported in a carrier or with protective covering.

20.5. Recognised assistance dogs will be carried in accordance with applicable law and must not be refused merely because pets are not normally accepted.

21. Cleaning and damage

21.1. The Rider is responsible for damage or excessive soiling caused intentionally or negligently by the Rider, accompanying persons, a supervised child or an animal brought on the Ride.

21.2. Ordinary wear and routine cleaning expected from normal use do not give rise to an additional charge.

21.3. A cleaning or damage charge must be reasonable and supported by evidence such as photographs, invoices, estimates and Ride details.

21.4. Before or promptly after charging, GB TAXI POLSKA will provide information about the reason, amount and method of dispute.

21.5. The Rider may dispute the charge through customer support. Nothing in this section permits an arbitrary penalty unrelated to actual or reasonably estimated loss.

22. Promotions, ratings and feedback

22.1. Promotional codes, discounts, referral benefits or credits may be subject to separate conditions, eligibility rules, validity periods and value limits.

22.2. Unless stated otherwise, promotions are personal, non-transferable, not exchangeable for cash and may not be combined.

22.3. GB TAXI POLSKA may refuse or cancel a benefit obtained through fraud, duplicate Accounts, manipulation or breach of promotion conditions.

22.4. Riders and Drivers may rate each other. Ratings and feedback must be honest, relevant and lawful.

22.5. GB TAXI POLSKA may remove or disregard content that is fraudulent, abusive, discriminatory, defamatory, irrelevant or unlawful.

23. Complaints and refunds

23.1. A complaint may concern the Application, Ride, Driver conduct, price, payment, cancellation, waiting, no-show, cleaning, damage, refund or Account decision.

23.2. Complaints may be submitted through the Application or through the support/contact channel available at https://GblastMobility.pl. They should include enough information to identify the Rider, Ride or transaction and explain the requested resolution.

23.3. GB TAXI POLSKA may request additional information and may obtain an explanation from the Transport Provider or Driver.

23.4. GB TAXI POLSKA will respond to a consumer complaint within 14 days of receipt, unless a different mandatory period applies. The response will be provided on paper or another durable medium.

23.5. A full or partial refund may be granted for an unperformed Ride, duplicate or incorrect charge, incorrectly applied fee, material service defect or another justified reason.

23.6. Approved Electronic Payment refunds are normally made using the same payment method that the Rider used for the transaction. For credit and debit card transactions, the refund is made to the bank account or card used for the transaction, unless the Rider expressly agrees to another refund method that does not involve any cost for the Rider. The time for funds to appear depends on the Payment Service Provider and the Rider's bank.

23.7. Cash-payment refunds may be handled in cooperation with the Transport Provider.

24. Lost property

24.1. The Rider is responsible for checking the Vehicle and taking all personal property when leaving.

24.2. A lost item should be reported through the Application or customer support as soon as possible.

24.3. GB TAXI POLSKA may facilitate contact between the Rider, Driver and Transport Provider but does not guarantee recovery.

24.4. A reasonable return fee may be agreed where the Driver incurs time or travel costs to return an item.

24.5. Illegal, dangerous or perishable items may be delivered to an authority or handled as permitted by law.

25. Emergencies and accidents

25.1. In an immediate threat to life, health or property, the Rider should call 112 and should not rely solely on the Application or customer support.

25.2. Accidents, threats, assault, dangerous driving or serious misconduct should also be reported to GB TAXI POLSKA as soon as reasonably possible.

25.3. GB TAXI POLSKA may cooperate with the Transport Provider, Driver, insurers, emergency services and competent authorities where there is a lawful basis.

25.4. A Rider must not knowingly submit a false safety or emergency report.

26. Restriction, suspension, closure and appeal

26.1. GB TAXI POLSKA may warn, restrict, suspend or close an Account where reasonably necessary for safety, security, fraud prevention, collection of valid unpaid amounts, legal compliance or enforcement of these Terms.

26.2. Grounds may include false information, payment fraud, repeated unjustified chargebacks, violence, harassment, discrimination, deliberate damage, fake Ride Requests, promotion manipulation, Account sharing, serious cancellation abuse or unlawful activity.

26.3. Immediate action may be taken where there is an urgent safety or security risk, serious fraud suspicion or a legal requirement.

26.4. Where legally and practically possible, the Rider will be informed of the decision, main reason, duration and appeal method. Detailed information may be withheld where disclosure would compromise safety, security, an investigation or the law.

26.5. The Rider may appeal through customer support and provide supporting information. Where required by law, an appropriate human review will be available for a decision substantially based on automated processing.

26.6. Closing or suspending an Account does not remove outstanding payments, pending complaints, refund investigations or claims arising earlier.

27. Termination by the Rider

27.1. The Rider may stop using the Application and request Account closure at any time through the Application or through the support/contact channel available at https://GblastMobility.pl.

27.2. GB TAXI POLSKA may require identity verification and may delay final closure only as reasonably necessary to complete an active Ride, settle a payment, process a refund, investigate fraud, preserve evidence or comply with law.

27.3. Account closure does not automatically require immediate deletion of all personal data. Data will be handled according to the Privacy Notice and applicable retention obligations.

27.4. Rights of withdrawal or termination granted by mandatory consumer law remain unaffected. Cancellation of individual Rides is governed by these Terms and the Fee Policy.

28. Availability and third-party services

28.1. GB TAXI POLSKA will take reasonable measures to maintain the Application but does not guarantee uninterrupted operation, Driver availability, an exact arrival time or an exact journey duration.

28.2. Interruptions may result from maintenance, updates, network, cloud, map, payment or telecommunications failures, cyber incidents, power failures or events outside reasonable control.

28.3. The Application may rely on third-party payment, banking, mapping, navigation, cloud, SMS, telephone and mobile-platform services.

28.4. GB TAXI POLSKA is not responsible for an independent third party's systems or decisions except to the extent responsibility arises from GB TAXI POLSKA's own conduct or mandatory law.

28.5. Riders should allow appropriate additional time and consider alternatives where punctual arrival is critical.

29. Intellectual property and submitted content

29.1. The Application, software, database, designs, text, graphics, trademarks and related materials belong to GB TAXI POLSKA or its licensors.

29.2. The Rider receives a limited, personal, non-exclusive, non-transferable and revocable right to use the Application for personal use in accordance with these Terms.

29.3. The Rider must not copy, resell, commercially exploit, reverse engineer, scrape or misuse the Application except where mandatory law permits it.

29.4. The Rider must have the right to submit ratings, comments, photographs or other content and must not submit unlawful, threatening, discriminatory, defamatory, privacy-infringing or malicious content.

29.5. The Rider grants GB TAXI POLSKA a non-exclusive right to use submitted content only as reasonably necessary to operate the service, investigate complaints, prevent fraud, enforce these Terms, defend claims and comply with law.

29.6. Unlawful content may be reported through customer support. GB TAXI POLSKA may remove, restrict or preserve content where required or permitted by law.

30. Personal data

30.1. GB TAXI POLSKA processes personal data in accordance with the GB TAXI POLSKA Privacy Notice and applicable data-protection law.

30.2. Data may include Account and contact data, pickup and destination data, live and historical location data, Ride history, payment information, device data, ratings, communications, complaints, safety information and fraud-prevention data.

30.3. Necessary information is shared with the assigned Driver and Transport Provider to arrange and perform the Ride.

30.4. The Transport Provider may act as a separate controller for data required to perform the Ride, issue fiscal documents and comply with transport, tax, insurance and claims obligations.

30.5. Optional marketing or non-essential tracking consent will be requested separately where required and may be withdrawn without preventing use of the core service.

31. Liability

31.1. The Transport Provider is responsible for the Transport Contract and physical performance of the Ride, including the Driver, Vehicle, licences, insurance, safety and fiscal documentation.

31.2. GB TAXI POLSKA is responsible for proper performance of its own contractual and statutory obligations relating to the Application and Rider-transport intermediation.

31.3. GB TAXI POLSKA is not responsible for an independent Transport Provider's act or omission merely because the Ride was arranged through the Application, except where liability follows from GB TAXI POLSKA's own act or omission or mandatory law.

31.4. GB TAXI POLSKA is not responsible for loss caused solely by inaccurate Rider information, Rider misconduct, the Rider's device or internet connection, failure to follow reasonable safety instructions or an event outside reasonable control.

31.5. Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited, including liability for intentional misconduct, fraud, injury or death where legally attributable, or mandatory consumer rights.

31.6. Road-accident claims may be handled through the relevant Vehicle, Transport Provider or responsible party's insurer. GB TAXI POLSKA may assist by providing available Ride information but does not guarantee acceptance of an insurance claim.

32. Amendments to these Terms

32.1. GB TAXI POLSKA may amend these Terms because of changes in law, regulatory requirements, the Application, services, payment or security systems, fraud-prevention needs or correction of errors.

32.2. Material amendments affecting existing Riders will normally be notified at least 14 days in advance through the Application, email or another durable medium, unless an immediate change is required by law, an authority, urgent security needs or fraud prevention.

32.3. Where active acceptance is legally required, the Rider will be asked to accept the amended Terms before continuing to use the service.

32.4. A Rider who does not accept a material amendment may close the Account before it takes effect.

32.5. A Ride already confirmed is normally governed by the Terms in force at confirmation.

33. Consumer dispute resolution, law and courts

33.1. A consumer should first use the complaint procedure in Section 23.

33.2. If a dispute is not resolved, the consumer may seek assistance from a municipal or district consumer ombudsman, a consumer organisation, the Trade Inspection or another competent out-of-court dispute-resolution entity.

33.3. Where required after rejecting a consumer complaint, GB TAXI POLSKA will state whether it agrees to participate in a relevant out-of-court procedure and identify the competent entity.

33.4. These Terms are governed by Polish law. This choice does not deprive a consumer of mandatory protection applicable under the law of their habitual residence.

33.5. Disputes are submitted to the court competent under mandatory procedural law. No clause in these Terms requires a consumer to use a court that is not legally competent.

34. Final provisions and contact

34.1. The Polish-language version is the primary version for services in Poland. Other language versions are provided for convenience. Mandatory law prevails in the event of inconsistency.

34.2. If any provision is invalid or unenforceable, the remaining provisions continue to apply.

34.3. Failure to immediately enforce a right does not constitute a permanent waiver.

34.4. These Terms, together with the Fee Policy, Privacy Notice, Cookie and App-Tracking Policy, Community and Safety Rules and any specific service or promotion terms, form the applicable agreement for use of the Application.
